If an order is canceled after payment has been processed, a full refund will be issued. Product descriptions and images are provided for informational purposes. We do not guarantee that colors or details will appear exactly as displayed on your device.

5. Risk of Loss and Title

All purchases are made pursuant to a shipment contract. Title and risk of loss pass to you upon our transfer of the products to the shipping carrier.

Once the carrier has taken possession of the order, we are not responsible for loss, theft, delay, or damage occurring during transit or after delivery confirmation. Customers must file claims directly with the carrier for lost or damaged shipments. We will provide reasonable documentation upon request.

6. Returns and Refunds

Our Return & Refund Policy is incorporated into these Terms.

Key conditions include:

• Returns accepted within 30 days of delivery

• Items must be unused and in original condition and packaging

• Customers are responsible for return shipping costs

• Original shipping fees are non-refundable

• We do not offer exchanges

7. No Exchanges

We do not offer product exchanges. Customers wishing to obtain a different item must return the original item (if eligible) and place a new order.

Massachusetts consumers are protected under Massachusetts General Laws Chapter 93A against unfair or deceptive business practices.

Products are provided “as is” and “as available.” However, nothing in these Terms is intended to disclaim or limit any implied warranties that cannot be disclaimed under Massachusetts law, including the implied warranty of merchantability where applicable. To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including warranties of fitness for a particular purpose and non-infringement. If a product includes a manufacturer’s warranty, claims should be directed to the manufacturer when appropriate.

10. Limitation of Liability

To the fullest extent permitted by Massachusetts law, ZenBuilt Performance shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or purchase of products.

Our total liability for any claim arising out of or relating to a product purchase shall not exceed the amount paid for the product giving rise to the claim.

Nothing in these Terms excludes or limits liability where such exclusion is prohibited by law, including liability under Massachusetts General Laws Chapter 93A.

11. Chargebacks and Payment Disputes

If you experience an issue with your order, you agree to contact us first to seek resolution before initiating a chargeback. We reserve the right to dispute chargebacks where we have complied with our posted policies and can provide proof of delivery or policy acknowledgment. Fraudulent or abusive chargebacks may result in refusal of future service.

22. ASSUMPTION OF RISK

Motorsport and high-performance activities are inherently dangerous activities involving substantial risk of: bike/vehicle damage, equipment failure, serious bodily injury, permanent disability, and death. By purchasing, installing, or using our products, you knowingly and voluntarily assume ALL risks associated with their use.

You acknowledge that:

• Carbon fiber is lightweight and performance-oriented, not indestructible

• Structural components may fail under racing stress

• No product can eliminate risk of injury or accident

22. Warranties

Products are provided “as is” and “as available” unless otherwise stated in product descriptions or applicable warranty documents. ZenBuilt Performance disclaims all other warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
